Regulatory Compliance Of Harmony CBD Spray

The Harmony Spray is our new CBD Oral Care Spray cosmetic product. It has passed all the tests required for the Cosmetic Product Safety Report and it has been notified on the European Cosmetic Products Notification Portal (CPNP). Our manufacturing facility featuring a clean room with automatic and semi-automatic filling machines is located in Germany. It is registered for the production of foods, supplements, cosmetics, aromas, sanitisers and vaping products with the local authorities and strict GMP and HACCP protocols are followed and regularly updated and inspected. The distribution of this product is legal in the European Union.

CBD in the Cosmetics Regulation

Cosmetics in the EU are controlled through regulation (EC) N° 1223/2009. This is the main regulatory framework for finished cosmetic products which are placed on the EU market. It is streamlined for all operators in the sector and strengthens product safety. The European Commission database for information on cosmetic substances and ingredients is called CosIng. It contains information from the Cosmetics Regulation (EC) No 1223/2009, the Cosmetics Directive 76/768/EEC, a glossary of common ingredient names for the purpose of labelling cosmetic products placed on the market, as well as opinions on cosmetic ingredients of the Scientific Committee for Consumer Safety (SCCS). CBD is listed twice in CosIng, as a natural extract and synthetically produced. Both entries specify that “it shall be prohibited from use in cosmetic products (II/306) if it is prepared as an extract or tincture or resin of Cannabis in accordance with the Single Convention”, which means that it is only prohibited when extracted from Cannabis flowers. This, in turn, means that CBD that is derived from the seeds and fibers of the plant or synthetically produced can be used in cosmetic products. Recently, this has led to the emergence of some more CosIng entries like “Cannabis sativa leaf extract” and “Cannabis sativa leaf/stem extract”.

Harmony products are made with CBD that complies with the European Commission database for information on cosmetic substances and ingredients.
 

Oral Care Cosmetics and Product Safety

The EU Cosmetics Directive defines a cosmetic as "any substance or preparation intended to be placed in contact with the various external parts of the human body (epidermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance and/or correcting body odours and/or protecting them or keeping them in good condition.". This means that products like toothpaste, mouthwash and oral care sprays fall under the cosmetics regulation, although they are not applied on the skin. Furthermore, cosmetic products placed on the EU market must be safe, which means they "must not cause damage to human health when applied under normal or reasonably foreseeable conditions of use." In order to ensure the safety of the products, they have to go through an expert scientific safety assessment before they are launched for sale. This includes the creation of a Cosmetic Product Safety Report (CPSR), and with this stability, packaging compatibility and preservative efficacy testing (for water containing products) in accordance with the European official methods of analysis. Products must also be notified on the Cosmetic Products Notification Portal (CPNP) before going on sale. Once they have been notified there, there is no need for any further notification at national level within the EU. The CPNP information is available to competent authorities and poison centers or similar bodies established by EU countries.

The Harmony Spray has successfully passed all the tests required for the Cosmetic Product Safety Report. It was notified on the CPNP in July 2020.
